A.9c Policy to govern use of Certification Mark

1. The Certificate Holder granted with the Certificate of
Approval (F.7) is entitled to use the Certification Mark given in the website.
2. The following terms and conditions shall govern the use
of the Certification Mark:
2.1 Use of Mark should be carried out in such a manner,
that it ensures traceability back to QMS Certification
Services.
2.2 Certified client should ensure that there is no
ambiguity, in the mark or accompanying text, as to what has been certified and that
QMS Certification Services has granted the certification.
2.3 The Certification Mark may only be used in correspondence,
advertising or promotional materials, internet etc. and shall not be used except
for products or services, sites included in ‘Certificate of Approval'.
2.4 The Certified Client shall not make or permit
any misleading statement regarding Certification nor shall the Certification documents
or part thereof be used or allowed to be used in misleading manner.
2.5 The Certification Mark shall not under any circumstances
be used on a product or product packaging seen by the consumer or in any other way
that may imply that the product(s) itself has been certified by QMS Certification
Services.
2.6 In case of Laboratory, Calibration or Inspection
Agencies, the Certification Mark can't be used on the reports, as reports itself
in these organizations are deemed to be products.
2.7 The Certified Client shall amend all the advertising
matter when the scope of certification has been reduced.
2.8 The Certified Organization undertakes to discontinue
any use of the Certification Mark, which is unacceptable to us or that would bring
us and/or certification system into disrepute and lose public trust.
2.7 The certified organisation shall not use the Certification Mark on the visiting cards.
3. Misuse of Certificates and Marks
2.7 The certified organisation shall not display the certification mark on buildings, organisational flags and vehicles except in publicity material like part of a large advertisement.
3.1 Should intentional misuse of Certificates or Marks
occur then a major CAR shall be raised and
an appropriate action may be taken which may include withdrawal of certificate,
information of withdrawal to customers and competitors, publication of such actions
in News papers and, if necessary other legal actions.
3.2 Should an unintentional
misuse of Certificates or Marks occur then dependent upon the severity and extent
of misuse an appropriately graded CAR shall be raised.
Should a minor CAR be raised then it must be closed out within three (3)
months or the CAR shall be regraded as ‘Major'.
4. Suspension or Withdrawal of Approval
4.1 In the event of suspension of Approval (as notified
by QMS CS in writing), the client need
not recall information relating to the Approval, but shall not issue any information
which infers that the approval is currently valid, or which includes the Certificate
or Marks relating to the Approval.
4.2 In the event of withdrawal of Approval (as notified
by QMS CS in writing), the client shall
recall all information relating to the Approval, and shall not issue any information
which infers that the approval is currently valid, or which includes the Certificate
or Marks relating to the Approval.
The client shall also return all certificates issued to them by QMS
CS.There shall be a reasonable
time allowed for the recall of information, after which disciplinary action may
be instigated, including legal action.
5. Adherence to the requirements of these
procedures shall be examined during each visit to the client. Instances of
non-fulfilment of these requirements may also be discovered by other means and may
result in the issuance of a CAR.
